DECO and 16 European consumer associations have reported Chinese platform Temu to national authorities for failing to protect consumers and using illegal manipulation practices, in violation of recent EU legislation. In Portugal, the Digital Services Coordinator is ANACOM, your entity DECO filed its complaint.
Chinese online shopping platform Temu does not respect consumer rights by violating the European Union (EU) Digital Services Regulation.
On the one hand, this platform does not provide users with sufficient traceability of merchants who sell on its platform. On the other hand, they use manipulative practices, such as dark standards, and are not transparent about how they recommend products to users.
These breaches of the Digital Services Regulation, or DSA, add to concerns already expressed by consumer groups regarding the safety of products for sale.
Temu, which has more than 75 million monthly users in the EU, in most cases fails to provide consumers with important information about the product seller and is therefore unable to guarantee that the product meets product safety requirements within the EU.
This online shopping platform also provides insufficient information about its recommendation systems and how the various criteria it uses lead to the suggestion of certain products.
Furthermore, Temu is full of manipulation tactics – dark patterns – for example, to push consumers to spend more than they initially wanted or complicate the process of closing their accounts.
Deco Timo is therefore accused of violating the new EU legislation on online content, the Digital Services Act, on all the above points, and must now be investigated by national authorities and the European Commission.
